Dalam jual beli tanah, prinsip yang perlu Anda ketahui, sebagai berikut.

• Kepastian objek, yaitu tanah yang dibeli memiliki batas-batas jelas dan sama dengan suratnya.
• Kepastian subjek, yaitu orang yang menjual/mengalihkan adalah orang yang benar-benar berhak. Jika tanah itu telah bersertifikat, berarti yang berhak menjula adalah orang yang namanya tercantum di dalam sertifikat tanah (SHM) itu. Penandatanganan Akta Jual Beli dapat saja diwakilkan kepada orang lain melalui surat kuasa. Akan tetapi sebelum jual beli, surat kuasa harus diperiksa otensitasnya. Apakah dibuat oleh orang yang berhak tadi atau terdapat unsure pemalsuan tanda tangan.

Upaya koordinasi dengan aparat setempat sebaiknya dilakukan karena hal ini diperlukan, antara lain untuk mengecek keabsahan SHM. Anda bisa mengajukan permohonan surat keterangan pendaftaran tanah (SKPT) pada kantor pertanahan setempat. Hal ini akan membuktikan bahwa sertifikasi tersebut benar terdaftar dalam buku pendaftaran tanah dan terdaftar nama siapa.

Yang membuat akta jual beli adalah pejabat pembuat akta tanah (PPAT) sesuai dengan PP no 24 tahun 1997. PPAT ini bisa saja seorang notaries PPAT atau camat setempat. Penyertaan lurah hanya membuatkan surat keterangan tidak sengketa atau keterangan kependudukan si penjual.
